1. Introduction and Acceptance

These terms and conditions govern the use of our services, on-site activities, and communication provided by RGD Concrete Services through our website www.rgdconcreteservices.net and related physical construction agreements. By engaging our services, requesting estimates, or accessing our platform, you acknowledge that you have read, understood, and agreed to these terms in full.

2. Quotations and Estimations

All written or verbal estimates provided by RGD Concrete Services are preliminary assessments valid for exactly thirty (30) days from the date issued. Final contract prices may scale based on hidden obstacles, structural changes, or unexpected design requirements requested during physical execution.

3. Excavation & Site Conditions

Prior to starting pool masonry, gunite installation, or demolition, the client must mark or communicate all subterranean lines and custom utilities. While we coordinate with municipal DigAlert (811) teams, RGD Concrete Services is not liable for structural damage caused to undocumented pipelines, custom irrigation, septic systems, or unmarked structural electrical lines.

Unforeseen physical site variables, such as underground water tables, hard rock layers, unstable soil conditions, or subterranean concrete debris from prior properties, will require structural changes and will be treated as extra-cost out-of-scope work.

4. Materials, Concrete, and Curing Disclaimers

Concrete, plaster, travertine, and natural flagstone are materials subject to subtle structural shifts, microscopic variations in texture, shade differences, and cracking over time. RGD Concrete Services uses standard reinforcements and cuts control joints in accordance with professional structural masonry guidelines. However, we do not guarantee structural concrete surfaces against natural hairline cracking, minor color fade, or scaling caused by shifting earth or chemical imbalances in pool water.

5. Permits, Regulations, and HOA Approvals

Unless specified as a designated expense in our written agreement, the property owner is responsible for securing necessary Homeowner Association (HOA) approvals, municipal permits, and structural engineering fees. Delays in permit issuance by local building departments are outside our structural scope and timeline limits.

6. Payments and Project Milestones

Clients must strictly follow the progress payment schedule outlined in their physical contract document. RGD Concrete Services reserves the right to halt work, clear the site, and retain materials if any milestone payment is delayed by more than three (3) calendar days. Unpaid amounts are subject to a standard 1.5% late interest fee per month.

7. Limitation of Liability

The total liability of RGD Concrete Services for any claim, structural dispute, or breach of warranty shall never exceed the absolute cash balance received from the client under the specific project contract. We are not liable for incidental, indirect, or consequential damages resulting from weather delays, force majeure events, or construction noise.
